SOUTH EAST CRUISING SCHOOL

Terms & Conditions (please print off and retain)

1. Payment of Deposit:- A payment of €75 per person is required with each Booking form if made at least 28 days prior to the course start date. If the booking date is less than 28 days from start date, then 100% of the fee is payable.

2. Confirmation of Bookings:- On receipt of Deposit and completed Booking form, we will confirm your course place in writing within 10 days Please note, we can only hold Provisional Bookings for 2 weeks without the €75 fee.

3. In the event of Cancellation within 28 days of start date, South East Cruising School reserves the right to resell the course and if not sold, then the customer will be liable for the full fee. No deposits will be refunded but can be transferred to another course at a later date. Failure to attend or if the customer leaves after a booked course commences, will result in the full fee being forfeited.

4. Age Considerations:- Persons between the age of 12 & 15 must be accompanied by a responsible adult on the course. Persons aged 16 & 17 may participate provided they are duly authorised by their Parent/Guardian.

5. Responsibility:- The Skippers/Instructors decision will be final on all matters regarding the safety of persons on board and the vessel. Trainees and Crew are asked for their cooperation in this regard.

6. Course Duration:- Weekend- Join the boat Sat 8.30am (poss. Fri 20.30 ) and finish Sun c.17.00

5 Day- Join the boat Sun 20.00 and finish the next Fri c.17.00.

7 Day- Join the boat Sat 10.00 and finish the next Fri c.17.00.

Other Options- By mutual arrangement

South East Cruising School will make every effort to maximise sea time for course participants. In the event of adverse weather conditions or other safety considerations curtailing time at sea, no liability shall attach to South East Cruising School, and the Skippers/Instructors decision will be final.

7. If it is necessary for South East Cruising School to cancel a Course, the full fee (less 5% admin. charge) will be refundable/transferable to a similar course, with no further liability attaching to the School.

8. In the event of any Damage or Breakages or loss of equipment overboard, please notify the Skipper/Instructor immediately for safety reasons. Personal belongings are the sole responsibility of the Trainee.

9. Personal Accident Insurance - it is strongly recommended that you take out Insurance for personal accident, as sailing is an outdoor adventure activity with an inherent risk of possible injury. The school is fully covered for Third Party Liability, but this might not cover you in the event of a no fault accident, causing you to lose time at work or worse.

10. - (a) As this is a live aboard course, all participants are expected to help with cooking, cleaning and running the vessel as required by the Skipper/Instructor. All participants are expected to thoroughly clean the vessel at the end of each course before departing.

- (b) On most trips, my dog, Toesun, will usually be on board, so if this causes a problem, please advise us well in advance, so that we can have him homed.

11. Your course fee includes Accomodation on board, Tuition and sleeping bag/boots. Oilskins can be hired for a nominal fee and Food/Harbour/Marina Fees will be the responsibility of Course participants. There will be a fee for Transfers to or from Dublin, if required (public transport readily available).

12. Own Boat Instruction will be subject to all of the conditions herein plus the Trainee will be expected to reimburse any travelling/out of pocket expenses for the Instructor from Wicklow. The trainees Yacht should be well equipped to an acceptable Safety standard appropriate for the intended Sailing area (RNLI Sea Check?). TheOwners Insurance Company should be notified in advance that an Instructor will be in charge for the course duration.

13. Sunshine Sailing or Overseas Sailing Trips booked in Ireland for enjoyment abroad through South East Cruising School or Greencoasts Charter will be subject to the normal applicable Terms and Conditions, in addition to any further requirements necessary to comply with Airline Travel Regulations, Boat Charter Regulations or Local Legal requirements in the relevant country(ies). Holiday Insurance with cover for sailing activities is essential for all such holidays and must be in place prior to departure from Ireland for the full duration.

14. All intending participants must complete the Health Declaration when Booking the desired course . It may be necessary for your Doctor to certify your fitness. Anyone not in a position to comply with these requirements may not participate on the course.

15. Where deemed appropriate by the Instructor, Certificates and signing of Log Books will be completed at the end of the Course. To maintain standards, Trainees must satisfy the appropriate criteria (as set out in the ISA or RYA Log Book) before a Certificate will be awarded (where applicable).

16. The Contract shall be deemed to have been entered into in the County of Wicklow and any dispute arising on foot of the Contract shall therefore be within the Jurisdiction of the Laws of the Republic of Ireland even when the dispute occurs outside Irish Terretorial waters.
